I. Identity and Domicile.

ELEMENT FLEET MANAGEMENT CORPORATION MEXICO, S.A. DE C.V. (the “Responsible Party”) in compliance of the provisions of the Federal Law for the Protection of Personal Data in Possession of Private Parties, its Regulations and the Guidelines of the Privacy Notice (the “Law”) hereby makes of your knowledge this integral privacy notice (the “Notice”) which intends to make of your knowledge the terms and conditions of the treatment of ordinary, financial and sensible personal data, which from time to time will require to collect. 

For the purposes of this Notice, the Responsible Party hereby appoints as its domicile the one located at Av. Vasco de Quiroga 3000, Floor Level, Col. Centro de Ciudad Santa Fe, 01210, Federal District, Mexico.

II. Personal Data Subject to Treatment and its Purpose.

All personal information that you provide or make of the knowledge of the Responsible Party, shall be used to: (i) contacting you; (ii) comply with the contract, legal or any other obligations that You enter into with the Responsible Party, (iii) keeping updated your profile in our database; (iv) performing any notice or sending of information needed; and in general, to (v) comply with the purpose of the relationship that has caused the treatment of personal data. The Responsible Party does not treat your personal data with purposes of marketing, advertisement or commercial prospection.

For the abovementioned purposes, we require to collect the following ordinary personal data: full name, partners name or corporate name of the company you represent, domiciles, country of residence, gender, date and place of birth, email, telephone, mobile, Federal Taxpayers’ Registration Code (RFC), Sole Population Registry Code (CURP), institution of Studies, school grades and places of current, previous, work (the “Personal Data”).

III. Sensible and Financial Personal Data Subject to Treatment and its Purpose.

Likewise, and subject to the Law, we hereby make you aware that the Responsible Party may collect the following sensible and/or financial personal data:

Employees and Professional Service Providers: general status of health, physical characteristics and/or pre-existent conditions (the “Collaborator´s Data”).

The Collaborator´s Data mentioned above, will be collected with the purpose of performing hiring, filing and handling of the corresponding internal file, granting, in its case, the agreed benefits, and with the intent of becoming aware of the possible candidates and collaborators.

Shareholders, clients and suppliers: bank account numbers, credit card number and/or debit account statements and/or financials, shareholding, participation percentage in several companies (the “Data of Clients and Suppliers” and collectively with the Collaborator´s Data, the “Financial and Sensible Data”).

The Data of Clients and Suppliers shall be collected and treated to perform the listing and services so hired and to fulfill the obligations resulting of such legal relationship.

For the treatment of your Financial and Sensible Data, the Responsible Party shall require of your express written consent for such treatment, provided that in the event of your failure to provide your express consent for the treatment of your Personal Data (including your Financial and Sensible Data), we may be rendered unable to offer you our products and services, as the personal data we request is necessary to perform our functions, as well as to contact you and establish a contract relationship.

The Responsible Party undertakes an obligation to treat all the Financial and Sensible Data it collects, under the strictest safety measure to guarantee their confidentiality.

IV. Media to collect Personal Data and Financial Data.

The Personal Data and Financial Data are collected through email, telephone with authorized personnel of the Responsible Party, the voluntary supply of information and personal data during interviews with authorized personnel of the Responsible Party, correspondence, the voluntary supply of information and personal data through dialogue windows in the website of the Responsible Party and/or the supply of data during the entry into the facilities of the Responsible Party as means of identification.

V. Transferences and Objectives.

For the transference of your Personal Data and Financial Data, we require of your express consent pursuant to article 36 of the Law, and in consequence, we will request your consent in order to be able to make such transfer, as needed.

Likewise, the Responsible Party may share the Personal Data with agents, correspondents and associated firms, national or foreign, which share internal processes and policies.

VI. Mediums and Procedures to exercise the rights of access, rectification, cancellation and opposition.

If you desire to access, rectify, suppress, copy or eliminate your Personal Data and/or Financial Data or request for us to stop using them for specific purposes in accordance with the Law, please contact the Legal Department of the Responsible Party, by sending us an email to jplanas@elementcorp.com or by calling to 5257 6225 specifying your name, address and the nature of your request and attaching the documents that evidence your identity as title holder of the Personal Data and/or Financial Data or, in its case, your legal representation of the title holder.

The Legal Department of the Responsible Party shall confirm receipt of your request on the date of receipt. An analysis pursuant to the Law, its regulations and the internal privacy policies shall be carried out and response will be given no later than 20 business days following its receipt, to which an affirmative or negative response might follow, which shall be fully supported. The response shall be sent to the email provided at the time of the corresponding request.

Please consider that certain Personal Data or Financial Data may be exempted from such access, rectification, suppression, copy or elimination pursuant to the applicable laws.

VII. Mediums to limit the use or disclosure of the Personal Data.

If you desire to limit or cancel the use or disclosure made by the Responsible Party over your Personal Data and/or Financial Data please contact the Legal Department of the Responsible Party, by sending an email to jplanas@elementcorp.com or by calling to 5257 6225 specifying your name, address and the nature of your request and attaching the documents that evidence your identity as title holder of the Personal Data and/or Financial Data or, in its case, your legal representation of the title holder.

If you desire to revoke the consent for the treatment of your Personal Data and/or Financial Data, please contact the Legal Department of the Responsible Party, by sending us an email to jplanas@elementcorp.com or by calling to 5257 6225 specifying your name, address and the nature of your request and attaching the documents that evidence your identity as title holder of the Personal Data and/or Financial Data or, in its case, your legal representation of the title holder.

The Legal Department of the Responsible Party shall answer your request no later than 20 business days following its receipt, to which an affirmative or negative response might follow, which shall be fully supported. The response shall be sent to the email provided at the time of the corresponding request.

IX. Use of cookies and other mechanisms in remote or local, electronic, optical or similar technologies, communication mediums.

The Responsible Party recognizes that its website uses cookies in connection with certain characteristics or features. The cookies are specific types of information that a website transfers to the hard disk of the computer and get stored in the browser you use in order to keep records of your activity. As the cookies may serve to facilitate the use of a website, by saving passwords and preferences while you browse the internet, we use browsing cookies, in order to help us to identify features of the website where you showed higher interest and, in such manner, improve your online experience.

The website of the Responsible Party does not use or store cookies to obtain personal identification data of your computer to obtain personal identification data of your computer which have not been sent as part of the cookie. The Responsible Party, through its Legal Department, implements the physical, technical and administrative security measures that are necessary for the protection and confidentiality of the Personal Data and Financial Data.

The Responsible Party may modify this Notice in order to implement and add new safety measures. Any modification to this Notice shall be noticed through our website or through email. The updated privacy notice shall be implemented 5 business days following its publication.
